Khairuddin files RM8m suit over wrongful Sosma detention


Khairuddin Abu Hassan filed an RM8.83 million suit for wrongful detention under the Security Offences (Special Measures) Act 2012 at the High Court in Kuala Lumpur today.
Khairuddin, who had lodged multiple reports in the country and overseas over the losses allegedly suffered by 1MDB, named as defendants the investigating officers in his case: Wan Aeidil Wan Abdullah, M Chelliah and Habibi Majinji; former inspector-general of police Khalid Abu Bakar; deputy public prosecutors Masri Mohd Daud and Awang Armadajaya Awang Mahmud; attorney-general Mohamed Apandi Ali; and the government.
He was detained under Section 124C of the Penal Code on Sept 18, 2015, and upon his release on Sept 23, was rearrested under Sosma and charged under Section 124L of the Act on Oct 12, for alleged sabotage of financial institutions.
Khairuddin – who will be standing in Jasin for Pakatan Harapan in the coming general election – was held for almost two monthsat the Sungai Buloh Prison, and made a habeas corpus application which he later withdrew after his release.
In his statement of claim, Khairuddin said the defendants had abetted caretaker prime minister Najib Abdul Razak on issues related to 1MDB.
He is seeking RM5.23 million in general damages, RM2.6 million for exemplary damages, RM1 million for prospective and continuing damages, as well as aggravated damages and other relief deemed fit by the court.
Khairuddin had been released after his Sosma detention before the High Court ruled, on Nov 18, 2015, that the charge against him and lawyer Matthias Chang under Section 124L of the Penal Code should not fall under Sosma.
The decision was upheld by the Court of Appeal and the Federal Court in 2016. - Mkini
