Rafizi withdraws constitutional challenge on Bafia


A three-member Court of Appeal panel today struck off the appeal by PKR vice-president Rafizi Ramli on his constitutional challenge to the Banking and Financial Institution Act 1989 (Bafia), under which he was charged and convicted.
This follows Rafizi, the former Pandan MP, withdrawing his appeal against his conviction under Bafia.
Deputy public prosecutor Jasmee Haneeza Jaafar informed the bench led by Justice Ahmadi Asnawi that Rafizi has agreed to withdraw his appeal during the last case management of this on June 7.
However, she said, Rafizi or his lawyers were not present today.
Following that Justice Ahmadi, who sat together with Justice Abdul Rahman Sebli and Justice Kamardin Hashim, agreed to strike out the appeal.
Rafizi and former Public Bank clerk Johari Mohamad were sentenced to 30 months’ jail earlier this year by the Shah Alam Sessions Court with violating Bafia by exposing accounts related to the National Feedlot Corporation Sdn Bhd and its chairperson Mohd Salleh Ismail, the husband of former Umno Wanita chief Shahrizat Abdul Jalil.
The Shah Alam Sessions Court had, in mid-2015, dismissed Rafizi's application to challenge the constitutionality of Bafia. The decision was upheld by the High Court in Shah Alam. - Mkini
