The Syariah High Court in Kuala Lumpur has fixed Nov 14 for Aminah Abdullah, the mother of the late Jamaluddin Jarjis, to file an affidavit in reply to widow Kalsom Ismail's attempt to strike out her faraid (Islamic wealth distribution) claim.
This was related by Kalsom's lawyer Shamsuriah Sulaiman as the case came up for management before a Syariah High Court registrar today. Lawyer Zuri Zabuddin Budiman appeared for her children.
Aminah, 83, is seeking her rightful share of the RM2.1 billion left behind by her late son. She wants the court to recognise that she is one of the rightful claimants to the estate, along with Kalsom and her children.
However, Kalsom and her children are seeking to intervene in the matter with an application to strike out Aminah's faraid claim.
Under Islamic law, if a deceased does not leave a will, the mother is entitled to receive one-sixth of the decedent's estate, while his widow gets one-eighth and the children are to receive the remainder.
Jamaluddin's stepbrother Mohamed Najeb Ali, who accompanied Aminah to today's proceedings, said that Kalsom has also filed an application for harta sepencarian (joint matrimonial assets).
"So now there are two applications (Aminah's application for faraid and Kalsom's application for harta sepencarian)," he said, adding that sulh (negotiations) have not resulted in any resolution.
In her faraid petition, Aminah claims that several landed properties – including houses in Malaysia, Saudi Arabia, and in the United States – are part of Jamaluddin's RM2.1 billion estate. The estate also includes shares owned by the late minister and those purportedly given to her grandchildren.
In total, the assets comprise 22 landed properties, mostly in Pahang and in the Klang Valley, 21 bank accounts worth over RM15 million – including one account in the US – and shares in 15 companies.
Jamaluddin, the former Rompin MP, was said to be a close confidant of former prime minister Najib Abdul Razak and had held various cabinet posts.
He and several others, including Najib's private secretary, Azlin Alias, died in a helicopter crash on April 4, 2015.
The report on the investigation into the helicopter crash said it was the result of pilot negligence. -Mkini
