The Attorney-General was sacked on 15th May 2018 and Anwar was pardoned on 16th May 2018. Some feel this was intentionally done so that Tun Dr Mahathir Mohamad can have a loophole later to rescind the pardon and send Anwar back to jail to serve the balance of his jail sentence.
The bottom-line is: Anwar’s pardon did not follow the Federal Constitution so for all intents and purposes the pardon was invalid. Hence Anwar can actually be sent back to jail.
Furthermore, Anwar’s pardon was not an acquittal so he is still regarded as an ex-convict. The pardon merely exempts him from serving the balance of his sentence. It does not commute the sentence. That means Anwar is still guilty of sodomy.
