KUALA LUMPUR: The High Court today dismissed a suit by National Feedlot Corporation (NFC) chairman Mohamad Salleh Ismail against Public Bank over the leakage of the company’s bank accounts.
Salleh, the husband of former minister Shahrizat Abdul Jalil, had accused the bank of breaching confidentiality.
But High Court judge Su Geok Yiam said that NFC and its subsidiary companies failed to prove their case against the bank on the balance of probability.
The court also ordered NFC to pay RM350,000 as costs.
Salleh, NFC and the subsidiary companies sued Public Bank in 2012, after details of transactions were revealed by then Pandan MP Rafizi Ramli.
They had sought RM560 million from the bank.
The bank’s lawyer, Yoong Sin Min, said the plaintiffs failed to prove that former bank employee Johari Mohamad had leaked the information to Rafizi.
“They had issued subpoenas to Rafizi and Johari to testify but chose not to proceed in the end,” Yoong said.
Rafizi and Johari were convicted and jailed for 30 months last year under the Banking and Financial Institution Act, or Bafia.
In June last year, the Court of Appeal struck out Rafizi’s bid to challenge the constitutionality of Bafia. - FMT
