Rohingya refugee drops case against govt after kids freed

 

Lawyer M Ramachelvam said the court rejected the Attorney-General’s Chambers assertion that Amanullah Kalamia had no locus standi and couldn’t file a judicial review.

PETALING JAYA: A Rohingya refugee has withdrawn a judicial review application against the government over the detention of his wife and five children.

Amanullah Kalamia withdrew the application after the immigration department released the five children, aged seven to 18 on December 29 last year. His wife, Khatijah Bashir Ahmad, 35, died in custody on July 26 last year.

The children had been in an immigration detention centre for the past two years.

In October last year, the Shah Alam High Court granted Amanullah leave for a judicial review of the immigration department’s plan to deport his five children to Myanmar.

The department issued a detain and deport order for them on September 14 last year.

According to lawyer M Ramachelvam, in granting the application, the court rejected the Attorney-General’s Chambers assertion that Amanullah had no locus standi and couldn’t file a judicial review for his wife and children against the order of the director-general of immigration as the order was not subject to review by courts.

The court said that Amanullah would be adversely affected if his wife and children were deported, and hence had the locus standi to commence judicial review proceedings, and further held that the director-general of immigration’s order could be reviewed by the court. - FMT
