It very clear that UMNO had not adhered to its own party constitution. The ROS should have informed UMNO by now that the UMNO party is already DEREGISTERED.
According to UMNO Constitution, Clause 9.3 reads that the UMNO Supreme Council is required to hold its polls every three(3) years, with a further extension of 18 months allowed under Clause 10.16.
UMNO President then, Datuk Sri Najib Tun Razak, in June 2015, announced that the party's elections would be postponed, as UMNO had to prepare for the General Elections.
UMNO Secretary-General, Tengku Adnan Tengku Mansor informed in February 2018 that the UMNO party polls would be held on 19 April 2018, after obtaining approval from the ROS.
UMNO fail to hold its party elections.
UMNO Secretary-General, Tengku Adnan Tengku Mansor informed that the ROS had granted them the second extension sought via her letter.
Its very clear that the ROS has no inherent power via Societies Act to grant a "second extension".
The ROS does not have the powers to keep UMNO registered without holding its party elections as stipulated under Clause 10.
Since the deadline was 19 April 2018 to hold its party polls, UMNO failed to hold its party polls.
On 20 April 2018, the ROS should have issued a letter stating that UMNO is deregistered.
The ROS need to explain why she has not carried out her duties as per her appointment as Registrar of Societies Malaysia.
