The Election Court in Seremban will hear the Rantau election petition filed by PKR's candidate for the 14th general election, Dr S Streram, next Wednesday (Sept 12).
This comes after Justice Azimah Omar of the High Court in Seremban disallowed a stay application by Umno deputy president and former Negeri Sembilan menteri besar Mohamad Hasan.
Streram's lawyer Rafique Rashid Ali revealed this to Malaysiakini today.
"The stay by Umno number two (Mohamad) has failed. The hearing of the election petition will be on Sept 12," Rafique said.
Lawyer Stella Sidhu, who is leading Streram's legal team, told the court that the petition had to be disposed of within six months of it being filed.
"Election courts are tasked to finalise petitions of such nature within six months expeditiously," she said.
Streram said he is elated with the court decision and intends to convince the court that he was illegally denied entry, leaving Rantau voters with no choice of an alternate representative.
Justice Azimah dismissed Mohamad's preliminary objection last month and ordered the matter to proceed to trial.
In his petition, Streram named Mohamad, the returning officer for Rantau state seat Amino Agus Suyub and the Election Commission as respondents.
The EC and Amino will not be represented by the Attorney-General's Chambers and they will have to appoint lawyers to appear for them.
Streram, a PKR member, claimed he was wilfully obstructed at the nomination centre, and thereafter systematically deprived of submitting his nomination papers to contest the Rantau state seat in GE14. - Mkini
