Court discharges cyclist after no-show by DBKL officer



The courts today discharged a 23-year-old cyclist of alleged obstruction of a Kuala Lumpur City Hall officer after the latter failed to appear in court.
Lawyer Eric Paulsen said the case against his client, Muhammad Nur Rabbani Shariffhuddin, was initially set for hearing at the Kuala Lumpur Magistrate's Court this afternoon.
"The complainant did not appear in court even though a subpoena had been served on him and he was contacted by the investigating officer.
"He (the complainant) did not respond so the magistrate granted my client a discharge not amounting to an acquittal," Paulsen told Malaysiakini.
Muhammad Nur Rabbani had claimed trial to the charge under Section 353 of the Penal Code for allegedly using criminal force to deter a public servant from discharging his duty.
He was accused of committing the offence against DBKL officer Muhd Farzli Mohamad at approximately 10.15am last Feb 19 outside DBKL's head office along Jalan Raja Laut.
A group of some 40 cyclists (above) had at the time gathered to protest DBKL's move to impound bicycles and claims that the local authority had damaged a RM3,000 bicycle which had been left locked by the roadside.
The cyclists also complained they are forced to park their bicycles along roadsides because there were no bicycle racks available. -Mkini
