(The Star) – Parti Pribumi Bersatu Malaysia (Pribumi) is challenging the Registrar of Societies’ (RoS) decision to disband the party.
Pribumi has filed an application for leave for a judicial review challenging the RoS director-general’s decision for issuing the disbandment order.
Pribumi secretary-general Datuk Dr Shahruddin Md Salleh filed the application at the Kuala Lumpur High Court registry via law firm Messrs Chetan Jethwani & Co on Thursday (April 5).
Shahruddin has named the director-general Surayati Ibrahim as the sole respondent in his application.
In the application, Shahruddin wants an order to restrain the respondent from misusing Section 14(5) of the Societies Act 1966 to issue the disbandment order, as announced in media statements.
The applicant asks for an order to prevent Surayati from taking any action to restrict Pribumi from being set up as a valid political party.
He is seeking a declaration that the party had on March 29 complied with the notice under Section 14(2) of the Act.
Shahruddin is also asking for a declaration that, based on the respondent’s letter dated April 2, Surayati has no basis to issue any dissolution order to prevent Pribumi from carrying out its activity as a registered political party and to contest in the 14th General Election.
The application has been set for hearing before High Court (Appellate and Special Powers) judge Justice Kamaludin Said on April 16.
