1MDB-linked Nik Faisal Ariff Kamil, Suboh Mohd Yassin and Gandingan Mentari Sdn Bhd are now the target of the Companies Commission of Malaysia (CCM) for alleged failure to submit the annual financial statement for 2017.
This was revealed during open court proceedings before Kuala Lumpur Sessions Court judge Manira Mohd Nor today.
CCM prosecuting officer Nur Nazhzilah Mohammad Hashim informed the court that they were not able to serve the summons on Nik Faisal (photo, above), Suboh and Gandingan Mentari.
It is understood that today was set to be the first mention of the case, in which Nik Faisal, Suboh and Gandingan Mentari were alleged to have failed to submit the 2017 annual statement to CCM in line with requirements under the Companies Act 1965.
The three separate cases are listed to be heard before the judge at the online cause list at https://ecourt.kehakiman.gov.my/.
Manira then fixed Oct 4 for mention to allow CCM to serve the summons on the two individuals and the company.
Neither Nik Faisal, Suboh, a representative of Gandingan Mentari nor their lawyers were present in court.
It is understood that the summoned persons have to be served with the summons before they need to attend proceedings.
Suboh (photo) is linked to the SRC International trial involving former prime minister Najib Abdul Razak.
Suboh had testified that he signed fund transfer request letters to transfer millions of ringgit from SRC International to its subsidiary Gandingan Mentari and its CSR partner, Ihsan Perdana Sdn Bhd.
On June 20, Suboh, former SRC International director, was called to the witness stand to testify for the prosecution in Najib’s RM42 million SRC International trial.
Former SRC International chief executive officer Nik Faisal, a key figure in the MACC’s investigation into the 1MDB scandal, remained missing and is still sought by the authorities.
During the SRC International trial, MACC investigating officer Rosli Hussain testified that Nik Faisal left Malaysia on May 7, 2018, two days before the 14th general election.
Gandingan Mentari, which is a subsidiary of SRC International, is part of the subject matter of the monetary trail in Najib’s SRC International hearing.
Previously a subsidiary of troubled sovereign wealth fund 1MDB, SRC International later changed hands and came under the Minister of Finance Incorporated (MoF Inc) in 2012. - Mkini
