Appeals court upholds policewoman’s conviction

Her 7-year jail sentence for concealing information on terrorism-related activities also remains.

PUTRAJAYA: The Court of Appeal today upheld the conviction and seven-year jail sentence of a policewoman for concealing information on terrorism-related activities from the relevant authorities.

A three-man panel comprising Mohtarudin Baki, Zakaria Sam and Abdul Karim Abdul Jalil unanimously dismissed Corporal Jusninawati Abdul Gani’s appeal against her conviction and sentence.

Justice Mohtarudin who chaired the panel said the court was of the view that the issues submitted by her counsel in the appeal did not have merit. 

Consequently, the court upheld the decision of the Kuala Lumpur High Court which found Jusninawati, 36, guilty of the offence and had sentenced her to seven years’ jail.

Jusninawati, who was based at the Petaling Jaya district police headquarters, was charged with intentional omission of information relating to terrorist acts at the police headquarters between August 2015 and March 22, last year.

Then judicial commissioner Nordin Hassan (now High Court judge) in finding Jusninawati guilty had held that it was unreasonable for her, as a police officer, to hide such information from the authorities.

She was represented by lawyer Faizal Rahman and Nik Zarith Nik Mustapha while deputy public prosecutor Nurshafini Mustafha appeared for the prosecution. -FMT
