Member of Johor royalty jailed two years for assault



The Court of Appeal today reduced the jail term for a member of the Johor royalty from four years to two years for seriously injuring national boxer Muhamad Farkhan Mohd Haron five years ago.
However, the bench, led by Justice Mohd Zawawi Mohd Salleh, retained the RM10,000 fine that Tunku Nick Tazuddin Izwan Syah Tunku Qadir, 32, was ordered to pay.
With this, Tunku Nick Tazuddin's jail sentence begins today. This case originated in the Sessions Court in Johor Bahru.
The other Court of Appeal judges were Justice Idrus Harun and Justice Yaacob Md Sam.
In announcing the decision, Justice Zawawi held that the Sessions Court judge was right in finding the accused guilty of the charge but said there was an element of provocation involved.
Hence, the judge said, imposing the four-year jail term was not appropriate.
“We allow the appeal to set aside the four years’ jail and substitute it with two years’ jail and for him to pay the RM10,000 fine,” Justice Zawawi said.
DPP Kwan Li Sa appeared for the prosecution while lawyer Mohd Daud Ismail appeared for Tunku Nick Tazuddin.
On June 28, 2013, the Sessions Court in Johor Baru found Tunku Nick Tazuddin guilty of committing the offence, under Section 325 of the Penal Code, at No 44, Jalan Molek 3/2, Taman Molek, between 4.30am and 7am on May 6, 2012.
A person convicted of an offence under Section 325 can be jailed for a maximum of seven years.
Tunku Nick is said to have resided at Istana Bukit Kesenangan in Johor Bahru.- Mkini
