Dewan Rakyat Speaker Pandikar Amin Mulia and secretary Roosme Hamzah have applied to strike out an originating summons filed by Petaling Jaya Selatan MP Hee Loy Sian over not being able to ask questions related to 1MDB.
This was disclosed at the High Court in Kuala Lumpur before Justice Kamaludin Md Said today. The judge fixed Jan 8 to hear the striking out application made by the speaker.
Hee, a second term PKR parliamentarian, filed the application in court challenging the speaker's decision not to allow questions related to 1MDB.
Opposition MPs had criticised Pandikar after he rejected more than 30 questions related to 1MDB in the latest Dewan Rakyat session.
Pandikar argued that the matter is not justiciable in court according to Article 63 (1) of the Federal Constitution, which states that the validity of any proceedings in either House of Parliament or any committee thereof shall not be questioned in any court.
However, Hee claimed the rejection of the questions prevented him and other lawmakers from carrying out their duties to ask questions on behalf of their constituents on 1MDB, thereby negating the function of Parliament.
Federal counsel Sallehuddin Md Ali appeared for the speaker, while lawyer Latheefa Koya appeared for Hee.-Mkini
