Harapan MPs lodge qazaf report against Husni's 'sodomy' accusation



Pakatan Harapan has urged the Federal Territories Islamic Religious Department (Jawi) to investigate former finance minister II Ahmad Husni Hanadzlah for qazaf, or the offence of accusing a person of sodomy without producing four witnesses.
Speaking during a press conference in parliament, Khalid Samad (Amanah-Shah Alam) referred to Husni’s reported allegations last Wednesday that jailed former opposition leader Anwar Ibrahim was allegedly involved in sodomy with his “anak buah.”
“What was done by the Tambun MP (Ahmad Husni) was to make an accusation without producing witnesses and state that his ‘anak buah’ was a victim.
“Islam wants to prevent any person from making vague and wild accusations. That is why whoever committed the qazaf offence will be caned 80 times,” said Khalid.
The Harapan MPs earlier lodged a report to Jawi on the matter under Section 41 of the Syariah Criminal Offences Act 1997.
The report was lodged in relation to Husni’s remarks in Parliament last Wednesday that jailed former opposition leader Anwar Ibrahim was allegedly involved in sodomy with his “anak buah.”
“We don’t know whether it (an investigation) will be done or not, but we leave it to Jawi,” Khalid added.
Husni did not explain what he meant by "anak buah," which could mean "subordinate," “protégé,” “nephew,” or “niece” in Bahasa Malaysia.
At the time, according to the Hansard, Husni made the remarks after he criticised several opposition leaders and praised Prime Minister Najib Abdul Razak, whom he claimed was poised to leave a "zero corruption" legacy.
Also present during the press conference today was Wong Chen (PKR-Kelana Jaya).
Asked about MPs’ immunity in the Dewan Rakyat, Wong Chen conceded that the privilege could be applied to Husni, but nevertheless insisted that Jawi investigate the former minister’s remarks.
“We are asking them to investigate…if they (Jawi) can’t take any actions, at the very least give guidance. At least we are asking Jawi’s opinions on this matter,” he said.
Hanipa Maidin (Amanah-Sepang), meanwhile, demanded that PAS issue a statement on Husni’s remarks as qazaf is an offence punishable under hudud law.
Referring to PAS’ plans to introduce hudud punishments and amend the Syariah Courts (Criminal Jurisdiction) Act 1965, Hanipa questioned whether Husni’s remarks would be considered an offence.
“PAS should issue a statement. This is a qazaf (an offence) under hudud. Can PAS tolerate a person who accused another person (of sodomy)?
“If they (PAS) want to implement hudud, we want to ask if matters like these fall under hudud,” he said.
Other MPs present included Johari Abdul (PKR-Sungai Petani), Raja Kamarul Bahrin (Amanah-Kuala Terengganu), R Sivarasa (PKR-Subang) and Fauzi Abdul Rahman (PKR-Indera Mahkota).- Mkini
