Minister's ex-aide pressured me for a cut over RM19m project fee, says witness

 


The Kuala Lumpur Sessions Court heard from a witness today that he was frequently pressured by Sayed Amir Muzzakkir Al Sayed Mohamad, who was political secretary to a former home minister, to hand over a portion of the RM19 million consultancy fees he received from a project involving the police force.

The consultancy fees related to a police tender for the Maintenance and Supply of Spare Parts for Infrastructure Equipment, Servers, Software and RMPNet System Radio Users.

The 15th prosecution witness, Al Khairi Group Berhad managing director Khairi Mat Jahya, 43, said Sayed Amir (above) claimed that he had introduced him to the owner of Nexuscorpgroup Sdn Bhd, known as Wan Azhar, and had also arranged a meeting with the then-home minister Hamzah Zainudin.

"Sayed (Amir) also claimed that he had helped Nexuscorpgroup secure the RMPNet project," he said when reading his witness statement during the trial of Sayed Amir, who faces three corruption charges involving RM350,000.

Earlier, Khairi, who has known the accused since 2003, said he was appointed as a consultant to Nexuscorpgroup for a fee of five percent of the contract value should the company succeed in obtaining the minister's consideration for the project.

He said that on April 28, 2020, Sayed Amir arranged a meeting between him and Hamzah, during which he obtained the minister's notation of "Datuk KSU for consideration" on Nexuscorpgroup's supporting letter.

The witness testified that he only learned the contract’s total value was RM359,539,662.50 (excluding sales and services tax) after Nexuscorpgroup received the Letter of Acceptance for the RMPNet project, which brought his consultancy fee to approximately RM19 million.

Khairi said after the project was awarded, Sayed Amir began demanding a portion of the fees, amounting to about RM9 million.

He also said Sayed Amir even threatened to block him from meeting the minister if his demand was not met, saying: "I will block you from meeting the minister if you do not agree to give me my share."

Hamzah flagged former aide’s conduct

The witness added that roughly two months before Sayed Amir was removed from his post, Hamzah personally contacted him to flag his former aide’s alleged misconduct.

"I did not appeal to him not to remove Sayed (Amir), even though we were close friends, because in my view it was better that he no longer served as a government officer, given how often he had pressured me.

“I felt the minister had made the right decision," he said.

On May 23, 2024, Sayed Amir, 43, was charged with two counts of accepting RM350,000 in bribes from Wan Azhar Mohamed Yusof as an inducement for helping Nexuscorpgroup secure the RMPNet tender for police, valued at RM381,112,042.44 (including SST).

The offences allegedly took place at the Yayasan Tanah Aku office in Solaris Dutamas, on Dec 4 and 16, 2020.

Sayed Amir was also charged with soliciting a RM350,000 bribe from the same individual for the same purpose at Nexuscorpgroup's office in Shah Alam in early December 2020.

The charges were brought under Section 16(a)(A) of the MACC Act 2009, which provides for a maximum prison sentence of 20 years and a fine of not less than five times the value of the bribe or RM10,000, whichever is higher.

The trial before judge Rosli Ahmad resumes tomorrow.
